On January 13th that it would resume accepting DACA renewal applications. Until further notice, USCIS is currently and will continue accept DACA renewal applications.

USCIS will accept DACA renewals from:
- DACA recipients whose DACA has expired or will expire on or after Sept 5, 2016 can apply for a renewal.
- DACA recipients who had DACA but whose DACA expired before Sept 5, 2016 can apply as an initial applicant, not as a renewal.

USCIS will not accept any first-time DACA applications.
- If you never had DACA you cannot apply.

SHOULD YOU APPLY for DACA RENEWAL?
- USCIS strongly encourages that DACA renewals are filed between 150-120 days before your DACA expiration date.
- DACA renewals filed earlier than 150 days before the expiration date will be accepted, but this can result in an overlap between your old and new DACA, meaning that your renewal would be extended for less than 2 full years from the date that your current DACA expires.
- There’s a lot we don’t know right now. We do not know how long USCIS will continue to accept DACA renewals. The decision can be overruled and stopped by a higher court any time. The Dept if Justice has filed an appeal of the injunction this week.  It is recommended that if you fulfill the requirements, that you assess whether to apply immediately.
