A Rhode Island man allegedly involved in the Jan. 6 attack on the U.S. Capitol is seeking a change of plea hearing with federal prosecutors, according to court documents filed on Friday.

Bernard Joseph Sirr, of North Kingstown, requested a change of plea hearing after reaching an agreement with federal prosecutors at the District of Columbia Court in Washington, D.C.

The documents state that Sirr is not in custody.

Sirr was arrested at his home last June after video allegedly showed him among the group of people who illegally entered the Capitol and got into a physical confrontation with capitol police officers in one of the tunnels at the Capitol Building.

He was charged with felony civil disorder and several misdemeanors.

Sirr was ordered to surrender his guns and his passport shortly after his arrest.

He was also ordered to not to enter Washington D.C. other than for court proceedings.

A change of plea hearing is set for Jan. 27 before Judge Trevor McFadden.
