Background:

The Republic of Tajikistan in close collaboration with international donor society has been implementing a Water Sector Reform over several years. For this purpose, a Water Sector Reform Program for the period of 2016 – 2025 has been developed and approved. The Program describes existing problems in the water sector, defines goals and objectives of the reform, mechanisms for achieving the goals and objectives, as well as necessary financial resources for the implementation of the reform. The document also serves as a roadmap for the reform implementation by offering a detailed Action Plan consisting of four sections that are a) development of legislation and regulation, b) institutional development, c) infrastructure rehabilitation and c) support tools for water sector reform.   

The Water Code of the Republic of Tajikistan was reviewed and a new edition was adopted on 2 April, 2020 as part of the Program Action Plan related to the development of legislation. In 2022, the Office supported the Agency of Land Reclamation and Irrigation (ALRI) in analyzing two (2) rules and one (1) resolution document. The draft by-laws have been circulated among water related agencies and institutions for comments and suggestions. In this context, the afore mentioned national expert will be responsible for coordination of proposed changes and recommendations and adaptation to the final by-laws.

Objective of Assignment: 

In this respect, the OSCE Programme Office in Dushanbe (POiD) plans to recruit a national expert to coordinate the draft resolution of the Government of the Republic of Tajikistan “On approval of the Regulations on the procedure for charging fees for services to supply water to consumers from state irrigation and irrigation systems”, “Rules for calculating the number of employees of water management organizations” and “Rules for budgeting and planning funds at the expense of water supply services in the melioration and irrigation system and Water Users Associations (WUAs) membership fees”;” with interested ministries and departments for their final approval.

Duration of Assignment:

3 months.

Tasks and Responsibilities:

Under the overall supervision of the Water and Energy Policy Adviser and under the direct supervision of the representative from ALRI, the national expert will be tasked with the following duties:

  1. Analyzing the comments and suggestions received from the water related ministries and agencies on three earlier developed by-laws from a legal point of view;
  2. In collaboration with the representative of ALRI is responsible for finalizing three documents and handing it over to the ministries and departments for re-approval;
  3. Getting positive feedback from ministries and departments on three by-laws;
  4. Coordinating the draft resolution of the Government of the Republic of Tajikistan “On approval of the Regulations on the procedure for charging fees for services to supply water to consumers from state irrigation and irrigation systems”, “Rules for calculating the number of employees of water management organizations” and “Rules for budgeting and planning funds at the expense of water supply services in the melioration and irrigation system and WUAs membership fees” with interested ministries and departments for their final approval;
  5. Assisting ALRI in preparation of the relevant documents/letters for sending three by-laws from the ALRI to the Government of the Republic of Tajikistan.

Deliverables:

–    Provision of short monthly reports (0.5 pager) of activities performed to the POiD;
–    Three afore mentioned by-laws will be finalized and submitted to the Government of Tajikistan.

Necessary Qualifications:

  • Relevant degree/specialty in the field of jurisprudence, an advanced degree is encouraged;
  •  At least 5 years of working experience in the field of jurisprudence;
  • At least 5 years of experience in projects funded by international organizations on legal, institutional, economic and other issues in the field of water resources management, land reclamation and irrigation and the environment;
  • Experience in drafting laws and regulations related to water resources management and in the field of land reclamation and irrigation;
  • Experience in the development of legal documents in the field of land reclamation and irrigation;
  • Good knowledge of the basics of the water sector reform and the expected tasks for the development of the melioration and irrigation sector, including WUAs;
  • Awareness of other sectors, in particular the ongoing reforms in agriculture;
  • Good communication, organizational and team working skills;
  • Good oral and written knowledge of Russian language;
  • Computer literate with practical experience using Microsoft applications; 
  • Demonstrated gender awareness and sensitivity, and an ability to integrate a gender perspective into tasks and activities;
  • Ability and willingness to work as a member of team, with people of different cultural, and religious backgrounds, different gender, and diverse political views, while maintaining impartiality and objectivity.

Remuneration Package:

Remuneration will be based on the selected consultant’s/expert’s qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
