RALEIGH, N.C. (WNCN) – The 24-year-old Apex man charged with leading deputies on a chase that ended in a fatal crash has a history of traffic convictions, court documents show. 

Timothy Cox is charged following the fatal collision on U.S. 1 on Jan. 16. 

A Wake County deputy reported seeing two vehicles traveling a high-rate of speed on U.S. 1 south. The deputy believed the vehicles were racing when one exited the highway onto Cary Parkway, court documents say.

Cox was driving one of the observed vehicles, a blue Volkswagen GTI. The deputy determined stopping the vehicle was in the interest of the public’s safety. 

Cox was weaving in and out of traffic at speeds exceeding 100 mph when the deputy activated his blue lights and siren, warrants say. 

Cox then turned around, made eye contact with the deputy and accelerated, the warrant says.

The 24-year-old was traveling in the “break down lane” near the U.S. 64 interchange when he hit a grassy patch, went airborne and collided with a red Volkswagen. 

That collision caused fatal injuries to Scott Durso, who was driving the red Volkswagen. 

Cox’s driving history shows he has several citations and convictions for speeding – sometimes for traveling at 25 mph more than the speed limit, warrants show. 

A Facebook account being used by Cox had images of the Volkswagen he was operating at the time of the crash, police said. There are posts showing that vehicle “operating grossly in excess of the speed limit.”

The account also has posts mentioned road rage incidents Cox was involved in, warrants say. 

Law enforcement are asking to look further into the Facebook. 

The warrant says additional charges against Cox are likely.
