Boardwalk Empire actress Paz de la Huerta is suing Harvey Weinstein for assault, battery and intentional infliction of emotional distress in connection with two alleged rapes in 2010.
According to the complaint, filed in L.A. County Superior Court, de la Huerta first met Weinstein in 1999 when she was a 14-year-old actress working on Cider House Rules. More than a decade later, in December 2010, she saw the mogul at a party for the premiere of Blue Valentine in Manhattan. She claims he offered her a ride home, because they lived near each other in the Tribeca neighborhood, and afterward insisted on coming up to her apartment. That’s when, de la Huerta claims, he threatened to harm her career if she didn’t have sex with him and then proceeded to rape her.

A week later, the two were photographed together and de la Huerta claims “seeking to have a photograph taken with his prior victim” was part of Weinstein’s “protective program” to derail future criminal or civil action against him.
Later that month, she claims, Weinstein showed up at her lobby and she drunkenly confronted him before he convinced her they should speak in private. The actress says he raped her again and then she blacked out.
In January 2011, Weinstein and de la Huerta were both in L.A. for the annual American Film Institute Awards luncheon, which took place the same week as the BAFTA awards and Golden Globes. She says he saw her in the lobby of the Four Seasons and called her cellphone to ask her to join him to discuss their dispute. He said he was in public and with other people, so she agreed, according to the complaint. He excused himself almost immediately and a concierge later handed her a note that asked her to meet him in his hotel room. When de la Huerta arrived at his room, she claims he opened the door in a bathrobe and offered her a threesome with another woman who was in the room. She says Weinstein was angry when she told him to leave her alone and left.
The next day, she attended The Weinstein Co.’s Golden Globes afterparty where her emotions made her drink so heavily that she was denied entry to another event at Chateau Marmont. A video of her falling down made the rounds online, which she says caused her additional emotional distress.
At the 2012 AFI event Weinstein was photographed with director and Boardwalk Empire executive producer Martin Scorsese. De la Huerta was terminated weeks later and she claims Weinstein made good on his “threats to harm her career if she defied him.”
De la Huerta is suing Weinstein for assault and sexual battery. The actress is also suing TWC and the Four Seasons Hotel Los Angeles at Beverly Hills for intentional infliction of emotional distress, among other claims.
