Subject: Legislation to Regulate Pipeline Land Agents
 

Based on the many pipelines slated to cross Pennsylvania and on numerous constituent calls received by our offices concerning the behavior of pipeline land agents, we will soon reintroduce legislation to amend Pennsylvania's Real Estate Licensing and Registration Act. The bill, SB 835 of 2017-18 Legislative Session, was voted favorably out of the Senate Consumer Protection and Professional Licensure Committee on April 24, 2018 was not considered by the full Senate prior to the end of the 2017-18 Legislative Session. Specifically, the bill:

Defines Land Agent as: A person who, in the course and scope of the person’s business in this Commonwealth and on acting on the person’s own behalf or on behalf of a prospective lessee or buyer, has been engaged primarily in:

· negotiating the acquisition or divestiture of oil, gas or mineral rights, including the acquisition
​ or divestiture of land or oil, gas or mineral rights for a pipeline.

· negotiating business agreements that provide for the exploration for or development of oil, gas
or minerals.

· determining ownership of oil, gas or minerals through research of public and private records.
· reviewing the status of title, curing title defects, and otherwise reducing title risk associated
with ownership of oil, gas or minerals.

· managing rights or obligations derived from ownership of interests and oil, gas or minerals.

· activities to secure the unitization or pooling of interests in oil, gas or minerals.

Requires Registration with the Pennsylvania Real Estate Commission, allowing for public access to a listing of registered agents. Requires criminal history background checks of agents and provides the Commission with authority to revoke or suspend registration certificates for a number of reasons such as fraud or misrepresentation.
