Subject: Protecting Insurance Coverage for Individuals with Preexisting Conditions
 
On December 14, 2018, a Federal judge in Texas ruled that the Affordable Care Act was unconstitutional. This ruling could have substantial consequences to healthcare across the nation including allowing insurance companies to exclude coverage for pre-existing conditions.

In the near future, we will be reintroducing Senate Bill 958 which prohibits health insurance companies from using an individual’s preexisting medical conditions to deny or exclude coverage under a health insurance policy.

Actions by the Federal court and the Trump Administration have dismantled a popular and important provision of the Affordable Care Act (ACA) that prohibits an insurance company from denying an individual insurance coverage because they have a preexisting health condition. Several States have sought and been approved for a waiver from this requirement and have begun selling insurance policies on the ACA marketplace that deny coverage to individuals with preexisting conditions.

While Governor Wolf has announced that as long as he is Governor he will not seek a waiver from the federal Government, we believe this legislation is important in order to prevent any future Governor from seeking a waiver that would allow insurance coverage that does not cover preexisting conditions be sold through Pennsylvania’s ACA marketplace. Our legislation would accomplish this by amending the Insurance Company Law to prohibit health insurance companies from denying or excluding coverage based on an individual’s preexisting medical conditions.
